Reachout Toy Library

Members agree to:

SAFETY Reachout Toy Library follows Toy Libraries Australia’s recommendations as much as possible. Warning labels are posted on toys that have small parts and are not suitable for children under 3 years old. For safety, please follow the guidelines below: 

• Check all toys and parts for safety before allowing children access to them.

• Inform staff if any of the toys or packaging are broken, have lost their warning labels, have been repaired or you feel they are unsafe in any way.

• Do not allow children access to packaging, boxes, plastic bags, straps, netting, etc. which we use to store the toys.

• Provide helmets and protective gear for use with bikes and ride-on toys.

• Ensure that children have adequate supervision while using the toys.

• Ensure that the toy is appropriate for the age and ability of the child.

• Ensure that the toy is used in the appropriate manner and for the purpose in which it was intended.

• Supervise your children while visiting the Toy Library

TOY ALLOCATION Up to four toys per member family and 8 toys per group membership.


BORROWING PERIOD The borrowing period is for up to 2 weeks.


CHECKING TOYS It’s a good idea to check toys before your children play with them, preferably at the time of borrowing. If a piece is missing or damaged please let staff or a committee member know. So that all our toys are available for borrowing as often as possible, we do ask you to return them to the Toy Library before being borrowed by another member.


LOST OR DAMAGED TOYS As parents ourselves we understand that damages and  loss happen - please don’t worry about this unduly - just  let us know when you return your toys. You’ll be surprised how often that lost piece turns up! We make small additional charges for the following:

• Missing piece or missing bag: $2 per item (this is refunded when it is returned)

• Damaged piece due to wear & tear or a design fault: no charge

• Complete toy lost or major damage: assessed by the Committee


OVERDUE TOYS Toys are on loan for up to two weeks. You are more than welcome to email the Toy Library (gitoylibrary@bigpond.com) if you need to extend your borrowing period. However, some toys are really popular, so we try to have toys returned as soon as practical so everyone has a chance to play!

COMMITTEE Members are encouraged to join our committee.  We want to create a supportive network among our wonderful members, and spending time with others is a great way to meet people and find out about whats going on in our community. Being on the committee involves attending a monthly meeting (usually only an hour). Volunteering to assist with fundraising and helping with the maintainance and stocktake of toys is always appreciated.


CARE OF TOYS When borrowing an item from the Toy Library the item is your responsibility. Toys should be brought inside overnight, including bikes, slides and climbing frames. Please treat Toy Library toys and packaging with all reasonable care. Please return toys in their bags/boxes in a clean and dry condition. We have a helpful little cleaning guide to make this easy!


WAIVER, RELEASE AND INDEMNITY FOR BICYCLE AND SCOOTERS

 

The Reacout Toy Library ("Provider") is pleased to make bicycles and scooters available to subscribers ("the Service").

 

As a subscriber to the Service you acknowledge that there are dangers and risks inherent with bicycle and scooter riding (the “Activity”) to which any child under your supervision ("Your Child") may be exposed. It is your responsibility to ensure that Your Child wears a helmet at all times and is otherwise appropriately attired when participating in the Activity. You agree that Your Child will participate in the Activity at your own risk. You also agree to voluntarily assume responsibility for supervising the Activity and any injury, death or property damage you or Your Child may suffer or cause as a result of participating in the Activity.

 

To the maximum extent possible at law, you (both in your personal capacity and on behalf of Your Child) agree to release, hold harmless and indemnify the Provider and its respective officers, employees, servants, agents and contractors (the “Indemnified Persons”) against all actions, claims, suits, costs, expenses, demands and damages suffered or incurred by the Indemnified Persons or any one or more of them by reason of, or in respect of, or in any manner whatsoever arising out of, or caused by, your use of the Service or Your Child's participation in the Activity.

 

You agree that you are subscribing to the Service on the express condition that the Provider:

 

(a) will, under no circumstances be liable or responsible in any manner whatsoever for any death, loss, accident, damage or injury to you, Your Child or any of your servants, agents, contractors, visitors or invitees or any other person whatsoever (“Related Party”) which may happen as a result of your use of the Service or Your Child participating in the Activity; and

 

(b) will not incur or be under any liability whatsoever to you, Your Child, or to any Related Party for any loss, damage or injury to or in respect of any of your property or of any Related Party’s property.

 

The Provider is not liable to you, Your Child or any Related Party in respect of any indirect or consequential loss. For the avoidance of doubt, ‘consequential loss’ means loss or damage arising from a breach of contract, tort (including negligence), under statute or any other basis in law or equity of an indirect or consequential nature including, but without limitation, loss of profits, loss of revenue, loss or denial of opportunity, loss of goodwill, loss of business reputation, future reputation or publicity, damage to credit rating and indirect, remote, abnormal or unforeseeable loss, or any similar loss whether or not in the reasonable contemplation of the parties.
